1. Application of the general terms and conditions of sale

These terms and conditions of sale apply to all orders placed on the www.tonnycat.com website.
SAS OVERDRIVE reserves the right to adapt or modify these terms and conditions of sale at any time. In the event of modification, the general sales conditions in force on the day of the order will be applied to each order.
Our product offers and prices are valid as long as they are visible on the site, within the limits of available stocks.
OVERDRIVE reserves the right to modify its prices at any time, but undertakes to apply the current prices indicated at the time of your order.

2. Order

On receipt of your order, we will check the availability of the product(s) ordered.
In the event of unavailability, we undertake within 30 days of order validation either to inform you of the period of availability, so that you can decide to maintain your order as is, or to offer you a similar product at a similar price, or to reimburse you by cheque.
The order validation date corresponds to the order date for online credit card payments. In the case of payment by cheque or money order, the order validation date corresponds to the date on which your cheque or money order is cashed by OVERDRIVE.

3. Acceptance of these terms and conditions

All orders imply full and unreserved acceptance of these terms and conditions of sale.

4. Payment

Our goods are payable in cash, without discount, at the time of ordering via our online service.

You can pay :

- by CB / VISA credit card

- by PAYPAL

- by bank transfer

 

Cancellation

Any termination of the General Terms and Conditions binding the Vendor and the customer shall entail termination of the General Terms and Conditions between Alma and the customer.

5. Security

Your credit card details are encrypted using SSL (Secure Socket Layer) protocol and are never transmitted unencrypted over the network. Payment is made directly to the bank.
OVERDRIVE has no access to these details, and does not store them on its servers.
For this reason, you will be asked to provide them again each time you make a new transaction on our site.
OVERDRIVE reserves the right to ask you for a copy of your identity card and proof of address.

Under the new EU directive on online payments(PSD2), you may be asked to provide additional authentication information at the time of payment.

The 3-D Secure feature enhances the security of credit card payments over the Internet.
This feature enables customers to confirm electronic payments by means of a password, one-time code or fingerprint.

The authentication process depends on your bank.

Many banks offer a cell phone application or an electronic box system for issuing a single-use code.
Fraudsters can therefore no longer shop on the Internet using stolen credit card data such as the card number or visual cryptogram.

The European Payment Services Directive ( PSD2 ) covers all digital payment methods. The exact process of the new authentication method depends on your bank and cannot be changed by the online store you visit.

This process is designed to further protect users when using online payment services, and to prove that the credit card payment is indeed initiated by the cardholder. Online payment is therefore even safer for customers!

The directive provides for three different types of authentication:

  1. by knowledge, with, for example, a password, the answer to a secret question or a PIN code
  2. by possession, e.g. your smartphone, smartwatch or authentication token
  3. by inherence (ownership or behavior), such as your fingerprint, facial recognition or retinal print.

For each payment, two different authentication methods must be used.

To ensure the convenience of online shopping and minimize the number of verification steps for customers, a few exceptions have been made.

  • For small amounts with a purchase value of less than €30, enhanced authentication is not, for the time being, required.
  • Recurring payments, such as monthly fees for an online service, do not fall within the scope of the PSD2 directive.
  • Authentication, or the whitelisting of an e-tailer, meaning that it will be considered trustworthy by the customer. However, this only works if the credit card issuer offers this option and agrees with the customer's choice of trusted beneficiary.

6. Order cancellation and refusal of delivery

SAS OVERDRIVE reserves the right to refuse to make a delivery or to honour an order in the event of a technical problem relating to the operation of the site (incorrect display of product or price information, for example) and in particular a computer problem.
In this case, SAS OVERDRIVE will cancel the order and refund all funds already paid.
A confirmation e-mail will be sent to inform you of this.
SAS OVERDRIVE reserves the right to refuse to make a delivery or to honor an order from a consumer who has not paid in full or in part for a previous order, or with whom a payment dispute is in progress.
In this case, SAS OVERDRIVE will cancel the order and reimburse all funds already paid.
An e-mail confirming the refund will be sent to you.

Cancellation of an order in preparation: For logistical reasons, an order in preparation by our team cannot be cancelled or modified. You have 30 days from receipt of your order to return it to us. You will be offered a refund or credit note.

7. Retention of title and transfer of risk

Products remain the property of SARL OVERDRIVE until full payment has been received by SARL OVERDRIVE. However, as soon as the customer places the order, the risks of the goods delivered are transferred to the customer.

8. Anti-fraud controls

OVERDRIVE may carry out checks on orders validated on its site.
These checks are intended to protect OVERDRIVE from abusive practices by fraudsters.
For example, in the case of an order for which the delivery address is different from the billing address, our services may contact the two persons mentioned, i.e. the person attached to the billing address and the person indicated for the delivery address.
As part of these procedures, our services may ask you to provide all the documents required to release your order: proof of address and debit in your name, but also proof of address in the name of the person indicated for the delivery address, etc...
These requests are made by e-mail, then by registered letter with acknowledgement of receipt.

9. Shipping

Our goods travel at the buyer's risk. A flat-rate shipping charge per order to Metropolitan France will be added to the total of your order, and will be payable with your order via our secure online payment services.
In certain cases, shipping charges for certain items of significant weight or size, requiring a particular delivery method, may be surcharged.
These rates will always be indicated on your "basket" page when you select the item concerned (by clicking on the "order" button) before you make any payment.
Products are delivered to the delivery address you provide during the ordering process.
Please note that delivery does not include delivery to the customer's home. Your parcel will be delivered to your front door if you live in a house, or to the foot of the building if you live in an apartment. As a result, you will need to plan for your parcel to be brought upstairs.
All delivery times are calculated in working days. Our parcels are delivered exclusively against signature.
Product availability may vary between 1 and 30 days depending on the type of product ordered.
The times indicated correspond to the processing and preparation times for your order. They start as soon as the order is validated.
These times are average times. No delay will justify the cancellation of the order or give rise to any compensation or penalty. To these lead times must be added the carrier's delivery time.

Delivery times, generally between 24 hours and 20 days, are given as an indication and are respected as far as possible.
All our items are sent by private carrier. No delay will justify cancellation of the order or give rise to any compensation or penalty.
If products need to be returned to us, a return request must be made to our Customer Service Department:

  • within 60 days of delivery for retraction
  • within 60 days for defects, after the customer has notified us by registered letter with acknowledgement of receipt, and the hidden defect has been verified
  • within 60 days, if you have not received the correct reference.

Any claim made outside this period will not be accepted. In the case of a retraction, or if you have not received the correct reference, the return of the product will only be accepted for products in their original condition (packaging, accessories, instructions).
For shipments of any kind outside mainland France, we systematically specify the cost of postage in your basket, after identifying the destination of the order and calculating the cost according to the destination.

For technical and legal reasons, SARL OVERDRIVE will limit these shipments to a selection of destinations.

Products are delivered to the delivery address you have indicated during the order process.

  • within 60 days of delivery for withdrawal by registered letter with acknowledgement of receipt
  • within 60 days for defects, after the customer has notified us by registered letter with acknowledgement of receipt, and the hidden defect has been verified
  • within 60 days if you have not received the correct part number.

Any claim made outside this period will not be accepted. In the case of a retraction, or if you have not received the correct reference number, the return of the product will only be accepted for products in their original condition (packaging, accessories, instructions).

10. Samples

As part of promotional operations on behalf of our partners, you may receive promotional samples and messages free of charge in your parcel.
Only one sample per person and per order is distributed.
In some cases, these free samples may not be distributed, even though they have been announced on your order form.
Processing is manual and may sometimes give rise to errors. No complaint will be taken into account by our Customer Service Department in this respect.

11. Returns

1) Returns with the reason "Does not live at the address indicated".

General
These are packages returned by the service provider responsible for delivery with the words: Does not live at the address indicated. Processing a return for the reason "Does not live at the address indicated".
After receipt and acceptance of your package by our services, depending on the nature of the product, available stocks and your wishes, we will offer to reship the product originally ordered or an exchange product with equivalent characteristics, at your expense.

2) Returns for "unclaimed" reasons

General
These are packages that have not been claimed by customers at the post office within the time limit set. Processing an "unclaimed" return.
After receipt and acceptance of your package by our services, depending on the nature of the product, available stocks and your wishes, we will offer to reship the product initially ordered or an exchange product with equivalent characteristics, at your expense.

3) Returns for "refused" or "spoliation" reasons

General
These are packages that have not been delivered to the customer due to spoliation: open packages, traces of impact, empty packages, etc.
If, at the time of delivery, the original packaging is damaged, torn or open, you must check the condition of the items.
If they have been damaged, you must refuse the parcel and note a reservation on the delivery note (e.g.: parcel refused because opened or damaged).

You refused your parcel at the time of delivery.
After receipt and acceptance of your package by our services, and after a written request from you, we will offer you a refund of your order by bank cheque.

You refused the parcel because it showed obvious signs of having been opened and/or bumped.
You must contact us to inform us of this.
You must ask the delivery service provider for a declaration of spoliation at the time of refusal.
After receipt and acceptance of your parcel by our services, depending on the nature of the product, available stocks and your wishes, we will offer to reship the product initially ordered or an exchange product with equivalent characteristics.

4) Returns for retraction

Terms of return
In accordance with article L.121-20 et seq. of the French Consumer Code, you have 60 working days from the date of delivery of your order to return any item that does not suit you, in its original packaging and in good condition, suitable for remarketing, and request reimbursement without penalty, with the exception of return costs.
In the event of retraction, the customer is responsible for return shipping costs.

ATTENTION: No retraction will be accepted if the returned product is unfit for remarketing.
Consequently:

  • The product must be returned in perfect condition, in its original packaging, unopened, unsealed, undamaged and unmarked.
  • The product must be accompanied by all accessories (manuals, cords, remote controls, warranties, etc.).

SAS OVERDRIVE reserves the right to refund the returned goods or to issue a credit note for the value of the returned goods.

This credit note will be valid for 1 year from the date of issue.

Failing this, the product will be returned to you at your expense.

In order to process your request correctly, please quote your order number and full contact details.

When returning products, we recommend that you overwrap the original packaging, as we can only take back products returned in their entirety with their original packaging, all of which must be intact and in good condition.

Refunds or exchanges assume that you have not damaged the product or returned it incomplete.

Otherwise, Tonnycat.com (OVERDRIVE) will be entitled to apply a discount to the returned product. If the product arrives unpackaged and damaged, Tonnycat.com (OVERDRIVE) reserves the right to return the product as is.

Return risks: precautions to take

We would like to draw your attention to the fact that in the absence of a prepaid label, you must return the product :

  • declare the value of the product, as shown on the purchase invoice
  • make sure that the return is fully insured, in line with the purchase invoice.

In the event of a return at your expense and without additional insurance, you are informed that the carrier will only compensate you up to the legal rate.

12. Claims

No order duly placed may be cancelled. Any well-founded complaint is accepted, but must be made in writing by registered letter with acknowledgement of receipt within a maximum of three days of receipt of the goods.

Any return of goods will be at the purchaser's expense and must be accepted in advance by our services, with the relevant invoice attached to the shipment, failing which it will be refused.

13. Manufacturer's warranty

Most of our products are covered by a manufacturer's warranty.

In order to benefit from this warranty, it is imperative that you retain the product purchase invoice.

The return of the product(s) covered by a warranty claim is at the customer's expense.

To benefit from a warranty, some products require an online declaration of your purchase on the manufacturer's website. This declaration  must be made within the deadlines indicated by the manufacturer.

13.1 WARRANTY EXCLUSIONS / Items neither returned nor exchanged:

  • Out-of-stock products cannot be returned or exchanged.
  • Personalized products (saddle, plate, deco kit, jersey, and any other personalized product) cannot be returned or exchanged.
  • Tires cannot be returned or exchanged after the 60-day withdrawal period.
  • Mounted or used tires cannot be returned or exchanged.
  • Wheels and tires delivered assembled are not returnable or exchangeable.
  • All exhaust systems (mufflers or pipes) after use are non-returnable and non-exchangeable.
  • All items requiring custom preparation (shock absorbers, etc.) are non-returnable and non-exchangeable.
  • Used transmission belts cannot be returned or exchanged.
  • Electronic boxes, chips, CDI racing and all articles containing electronic components are guaranteed for 30 days from the date of receipt of the article.
  • Electronic boxes, chips, CDI racing and all items containing electronic components are tested before shipment. However, if you notice a malfunction during connection or in the first few minutes of use, please contact us as soon as possible.
  • electronic boxes, chips, CDI racing and all items containing electronic components MUST have been handled and installed by a professional with motorcycle/quad electrical skills. The installation invoice will be requested. No warranty claim will be considered without presentation of the professional installer's invoice.

13.2 WARNING ON DYNOJET BRAND PRODUCTS : 

DYNOJET products must be installed by a professional motorcycle electrician. No warranty claims will be considered without presentation of an invoice from the professional installer.

All after-sales service requests will be made directly on the DYNOJET website. DYNOJET products are neither returned nor exchanged.

13.3 LIMITATION OF LIABILITY ON COMPATIBILITY INDICATIONS : 

In the event of a compatibility problem with the product purchased, OVERDRIVE cannot be held responsible for the "vehicle compatibility" information provided on the tonnycat.com website.

These data are provided directly by our suppliers as non-contractual information and are their sole responsibility.

If you have any doubts, our advisers will be able to answer them.

14. Customs duties

Any order placed on the www.older-racer.com website and delivered outside France may be subject to taxes and customs duties that are imposed when the package reaches its destination.
These customs duties and taxes are your responsibility.
We are not obliged to check or inform you of applicable customs duties and taxes.

15. Applicable law - Jurisdiction

French law is exclusively applicable to any contract concluded with OVERDRIVE or any order accepted by OVERDRIVE.
Any dispute or litigation shall be brought exclusively before the Courts of ANGOULEME (16), which shall have exclusive jurisdiction, even in the event of incidental claims, warranty claims or multiple defendants.

16. Penalty clause

Should OVERDRIVE be obliged to use the services of a debt-collection agency or to take legal action to obtain payment of unpaid invoices, a penalty of 10% of the outstanding sums will be applied, without prejudice to any interest on arrears.

17. Products offered

The products offered are subject to conditions of purchase amount, and within the limits of available stocks. They are limited to one per day and per person (same name, same address).

Data protection

In accordance with the provisions of the French Data Protection Act (Loi relative à l'informatique, aux fichiers et aux libertés N° 78-17 du 6 janvier 1978), data collected when placing an order has been registered with the CNIL (French Data Protection Authority) on 25/06/2006. You have the right to consult, modify and withdraw any personal data brought to the attention of TONNYCAT.
You can exercise this right by contacting the CNIL or by using the site's contact form. The information recorded is not passed on to third parties, and is only used internally for the processing and tracking of your orders as well as to keep you regularly informed of new products.

OUR DELIVERY TIMES :

The times indicated are shipping times, add the delivery time of the carrier (24H or 48H depending on destination).

Our shipping times are indicated several times before order validation, so please bear this in mind!

 

Our products can be :

1) Shipped within 24H / 48H / 72H : For products in stock at Tonnycat or at our supplier in France.

2) Shipped within 1 to 5 days / 5 to 10 days: For products in stock with our supplier in France.

3) Shipped within 8 to 15 days / 15 to 20 days / 20 to 30 days : Concerns a product in stock with our supplier abroad.

Exceptional lead time : Shipped within 1 to 2 months, concerns a product that must be manufactured on demand.

 

Your complete order will be shipped according to the item with the longest lead time. We will make only one shipment per order.

Our commitment:

  • an indication of how long you will have to wait for the product to be restocked.
  • or a modification of your order or a refund.

 

DELIVERY COSTS :

Delivery charges are always calculated as accurately as possible according to the weight and destination of your parcel. They will be indicated when you place your order.

They depend directly on our carrier's price list at the time your order is placed.

When ordering several products, it may happen that the shipment is split into several parcels.

In some cases, we will group items from several orders in a single parcel.

However, the shipping costs invoiced will never be higher than those estimated when placing your order.

For logistical reasons, TONNYCAT reserves the right to change the carrier of your order. You will be notified immediately.

 

FREE SHIPPING :

Shipping costs for your order will be offered for "point relais delivery" in mainland France, subject to the following conditions:

- the total value of your order must exceed 99 euros including VAT excluding shipping costs (this will be indicated when you place your order).

- The parcel (or the total of your parcels) containing your order must not exceed 20Kg.

- Free shipping does not apply to oversized packages. It must not exceed 1 meter.

 

DELIVERY CONDITIONS AND TRACKING :

The list of carriers compatible with the weight and size of your parcel(s) is indicated when you place your order.

The transport of your order will be ensured by the carrier(s) partner(s) of this offer at the time it is proposed.

TONNYCAT.com cannot be held responsible for carrier delays.

Our goods travel at the buyer's risk.

On the day your order is dispatched, you will automatically receive an e-mail or SMS from us indicating that your parcel(s) have left our warehouses.

The transport company will also send you (within 24 hours) a tracking number for each of your packages,

You will also receive a link to the carrier's website, enabling you to track your shipment in real time.

Items can be delivered by different carriers.

We offer several home delivery options, with or without signature.

 No claims can be accepted for delivery without a signature.

If you choose home delivery with signature, your parcel will be given to you personally against signature. Under no circumstances may the parcel be left with a neighbor.

 

DELIVERY METHODS :

 

WAREHOUSE DELIVERY :

Online ordering is MANDATORY to take advantage of this delivery method.

Do not come to the warehouse before we confirm that your order is ready!

 

 

HOME DELIVERY :

Home deliveries are made Monday to Friday between 8am and 6pm.

We recommend that you provide us with a delivery address where you, or a third party, can ensure receipt of the parcel during working hours.

You can indicate a delivery address different from the billing address when placing your order, and also specify a telephone number for the delivery address (if different).

If the carrier is unable to deliver your order, it will be held in its warehouse or in the nearest post office for you to collect it.

A delivery notice will be left in your mailbox.

 

 

DELIVERY TO RELAY POINTS :

You can choose to have your order delivered to a relay point near your home or workplace!

You will be offered this choice when you place your order.

The list of points relais is regularly updated by our carrier according to availability.

Some relay points may be periodically on vacation, in which case they will not be offered.

As soon as your parcel is deposited at the relay point, you will receive an SMS and/or e-mail to inform you.

 

 

DELIVERY OUTSIDE FRANCE :

For deliveries outside France, delivery charges depend on the destination and will be announced to you when you place your order.

For transport reasons, some products cannot be shipped to certain countries or to Corsica. In this case, you will be informed at the delivery stage of your order.

 

 

DELIVERY OF BULKY ITEMS :

Bulky items are bulky or heavy products requiring a special delivery method by appointment.

Within two days of your order being dispatched, our carrier will contact you to confirm that your order has been dispatched and is ready for delivery.

You will then be able to arrange a delivery appointment directly with him.

This contact can be made by email or telephone (SMS).

Your order will be delivered to the entrance of your home or the main entrance of your building.

Depending on the item ordered, we recommend that you ask for help in handling it.

This delivery will be made against signature.

Under no circumstances may the parcel be left with a neighbor.

 

 

CHECK YOUR PARCEL CAREFULLY:

To avoid any disputes, please always check your parcel in the presence of the delivery person!

Under no circumstances should you accept a parcel that is in poor condition, repackaged, wrapped in adhesive tape, too light or that has been opened during transport without first checking the contents.

If you follow these simple rules, you'll certainly avoid a delivery dispute:

If the parcel is damaged, refuse it!

If the parcel is in good condition, check the integrity of the contents in the presence of the delivery driver or La Poste counter clerk.

All delivery personnel are obliged to remain present while you check the condition of your items. Even if the driver is in a hurry and reluctant to let you check your parcel, insist on carrying out these checks. If an item is missing or damaged, refuse the parcel! If there is no apparent problem, but the package is not in perfect condition, accept the delivery with detailed reservations.

The words "subject to unpacking" are not valid in the event of a complaint: describe precisely what you have observed and take photos of your parcel (if possible before opening) from all angles.

In the event of a delivery dispute, we will file a claim with the carrier. If the carrier confirms that the parcel has been delivered to you, the claim file will be closed and we will not be able to  return the goods or reimburse you, as proof of delivery cannot be contested. 

 

TAXES AND DUTIES :

Taxes and duties are calculated according to your shipping destination.

Any claim made outside this 30-day period will not be accepted.


For a retraction, or if you have not received the correct reference, the return of the product can only be accepted for products in their original condition and packaging.

After filling in the return form, you will receive our acceptance and confirmation of your return by email.

You will be given a returns number.

Please write this number legibly on your parcel.

In the interest of restocking products, no returns will be accepted for a tire and rim pack delivered assembled, or for any customized item.

2/ Tick the item(s) that do not meet your expectations, then fill in the various options, and send.

After approval by our customer service department, and as indicated in our returns conditions, in the event of a delivery error on our part, a prepaid label will be sent to you upon approval of your return for reshipment of your parcel.

The product must be returned to us whole, undamaged, undrilled, undismantled, unmodified and in its original packaging, by Colissimo Suivi, to the following address:

HOW TO RETURN YOUR PRODUCT

1/ Place the product in new condition in its original box.

2/ Then place it in the shipping carton used for the return shipment.

CAUTION: NEVER USE THE ORIGINAL PACKAGING AS PACKING MATERIAL.

Put the product in its original packaging (in perfect condition), then place it in a neutral carton, taped shut.

3/ Put the documents you need for your return in the return box:

A copy of your purchase invoice + your return agreement.

Your returned products must be carefully protected to avoid damage to the parts in the box during transport, which will result in the refusal of your return.

REFUND PROTOCOL FOR YOUR RETURN :

Data retention period
